Aim: Patients with advanced cancer need information about end-of-life treatment options in order to make informed decisions. Clinicians vary in the frequency with which they initiate these discussions.Patients and methods: As part of a long-term longitudinal study, patients with an expected 2-year survival of less than 50% who had advanced gastrointestinal or lung cancer or amyotrophic lateral sclerosis were interviewed. Each patient’s medical record was reviewed at enrollment and at 3 months for evidence of the discussion of patient wishes concerning (...) ventilator support, artificial nutrition and hydration , resuscitation and hospice care. A Kaplan–Meier analysis was also performed and 2-year survival calculated.Results: 60 cancer and 32 ALS patients were enrolled. ALS patients were more likely than cancer patients to have evidence of discussion about their wishes for ventilator support , ANH , DNR and hospice care . At 6 months, 91% of ALS patients were alive compared with 62% of cancer patients; at 2 years, 63% of ALS patients were alive compared with 23% of cancer patients .Conclusions: Cancer patients were less likely than ALS patients to have had documented advanced care planning discussions despite worse survival. This may reflect perceptions that ALS has a more predictable course, that advanced cancer has a greater number of treatment options, or differing views about hope. Nevertheless, cancer patients may be less adequately prepared for end-of-life decision-making. (shrink)

Our objective is to test an optimality model of human fertility that specifies the behavioral requirements for fitness maximization in order (a) to determine whether current behavior does maximize fitness and, if not, (b) to use the specific nature of the behavioral deviations from fitness maximization towards the development of models of evolved proximate mechanisms that may have maximized fitness in the past but lead to deviations under present conditions. To test the model we use data from a representative sample (...) of 7,107 men living in Albuquerque, New Mexico, between 1990 and 1993. The model we test proposes that low fertility in modern settings maximizes number of grandchildren as a result of a trade-off between parental fertility and next generation fertility. Results do not show the optimization, although the data do reveal a trade-off between parental fertility and offspring education and income.We propose that two characteristics of modern economies have led to a period of sustained fertility reduction and to a corresponding lack of association between income and fertility. The first is the direct link between costs of investment and wage rates due to the forces of supply and demand for labor in competitive economies. The second is the increasing emphasis on cumulative knowledge, skills, and technologies in the production of resources. Together they produce historically novel conditions. These two features of modern economies may interact with evolved psychological and physiological mechanisms governing fertility and parental investment to produce behavior that maximizes the economic productivity of lineages at the expense of fitness. If cognitive processes evolved to track diminishing returns to parental investment and if physiological processes evolved to regulate fertility in response to nutritional state and patterns of breast feeding, we might expect non-adaptive responses when returns from parental investment do not diminish until extremely high levels are reached. With high economic payoffs from parental investment, people have begun to exercise cognitive regulation of fertility through contraception and family planning practices. Those cognitive processes maynot have evolved to handle fitness trade-offs between fertility and parental investment. (shrink)

Even though female food acquisition is an area of considerable interest in hunter-gatherer research, the ecological determinants of women’s economic decisions in these populations are still poorly understood. The literature on female foraging behavior indicates that there is considerable variation within and across foraging societies in the amount of time that women spend foraging and in the amount and types of food that they acquire. It is possible that this heterogeneity reflects variation in the trade-offs between time spent in food (...) acquisition and child care activities that women face in different groups of hunter-gatherers. In this paper we discuss the fitness trade-offs between food acquisition and child care that Hiwi and Ache women foragers might face. Multiple regression analyses show that in both populations the daily food acquisition of a woman’s spouse is negatively related to female foraging effort. In addition, nursing mothers spend less time foraging and acquire less food than do nonnursing women. As the number of dependents that a woman has increases, however, women also increase foraging time and the amount of food they acquire. Some interesting exceptions to these general trends are as follows: (a) differences in foraging effort between nursing and nonnursing women are less pronounced when fruits and roots are in season than in other seasons of the year; (b) foraging return rates decrease for Ache women as their numbers of dependents increase; and (c) among Ache women, the positive effect of number of dependents on foraging behavior is less pronounced when fruits are in season than at other times of the year. Lastly, in the Hiwi sample we found that postreproductive women work considerably harder than women of reproductive age in the root season but not in other seasons of the year. We discuss how ecological variation in constraints, the number of health insults to children that Hiwi and Ache mothers can avoid, and the fitness benefits they can gain from spending time in food acquisition and child care might account for differences and similarities in the foraging behaviors of subgroups of Hiwi and Ache mothers across different seasons of the year. Valid tests of the explanations we propose will require considerable effort to measure the relationship between maternal food acquisition, child care, and adverse health outcomes in offspring. These three papers present a quite diverse and complementary set of answers to the question, “Why Sexuality Matters to Philosophy.” They show the ways in which sexuality as an issue may be of interest to philosophers working on a wide range of questions. The theme of sexuality appears as both subject matter and context for the development of scientific theories of human behavior, as a pervasive dimension of the representation of everyday life, and as a social phenomenon raising important questions (...) bearing on the implications of equal citizenship for persons of different genders and sexualities. Sexuality reveals itself as implicated in epistemology and philosophy of science, aesthetics and ethics, political philosophy and jurisprudence. Sexuality as a subject matter provides rich examples for extending the treatment of quite traditional problems. At the same time, by identifying sexuality as a fundamental human phenomenon, fraught with normative implications and closely linked to emotional and bodily life, these papers show how thinking about sexuality may also act to unsettle and redefine certain important areas of philosophical inquiry. Recent, well-publicized accounting scandals have shown that the penalties outsiders impose on those found culpable of earnings management can be severe. However, less is known about how colleagues within internal labor markets respond when they believe fellow managers have managed earnings. Designers of responsibility accounting systems need to understand the reputational costs managers impose on one another within internal labor markets. In an experimental study, 159 evening MBA students were asked to assume the role of a manager in a company (...) and respond to a scenario in which another manager (the target manager) has the opportunity to engage in earnings management. Participants provided causal attributions, assessed the morality of the target manager, and indicated whether they would change their judgments about the target manager's reputation. The study manipulated three between-subjects factors: (1) whether the target manager chose to engage in earnings management, (2) whether the company's budgetary control system was rigid or flexible, and (3) whether the target manager's work history was average or above average. We found that causal attributions are affected more by the budgetary systems when the target did not manage earnings than when the manager did. We also found that morality judgments were significantly associated with the target manager's behavior, but not with the budgetary system. In addition, participants' judgments about the target manager's reputation were more strongly associated with morality judgments than with causal attributions. Previous accounting ethics research berates auditors for ethical lapses that contribute to the failure of Andersen (e.g., Duska, R.: 2005, Journal of Business Ethics 57, 17–29; Staubus, G.: 2005, Journal of Business Ethics 57, 5–15; however, some of the blame must also fall on regulatory and professional bodies that exist to mitigate auditors’ ethical lapses. In this paper, we consider the ethical and economic context that existed and facilitated Andersen’s failure. Our analysis is grounded in Akerlof’s (1970, Quarterly Journal of (...) Economics August, 488–500) Theory of the Market for Lemons and we characterize the market for audit reports as a market for lemons. Consistent with Akerlof’s model, we consider the appropriateness of the countervailing mechanisms that existed at the time of Andersen’s demise that appeared to have effectively failed in counteracting Andersen’s ethical shortcomings. Finally, we assess the appropriateness of the remedies proposed by the Sarbanes–Oxley Act of 2002 (SOA) to ensure that similar ethical lapses will not occur in the future. Our analysis indicates that the SOA regulatory reforms should counteract some of the necessary conditions of the Lemons Model, and thereby mitigate the likelihood of audit failures. However, we contend that the effectiveness of the SOA critically depends upon the focus and attention of the␣Public Companies Accounting Oversight Board (PCAOB) towards assessing the ethical climates of public accounting firms. Assessments by the PCAOB of public accounting firm’s ethical climate are needed to sufficiently ensure that public accounting firms effectively promote and maintain audit quality in situations where unconscious bias or economic incentives may erode the public accounting firm’s independence. The frequency of earnings restatements has been increasing over the last decade. Restating previous earnings erodes perceived trustworthiness and competence of management, giving firms strong incentives to take actions to enhance perceived credibility of future financial reports [Farber, D. B.: 2005, The Accounting Review 80(2), 539–561.]. Using an experimental case, we examine the ability of post-restatement actions taken by a firm to positively influence non-professional investors’ perceptions of management’s financial reporting credibility. Our examination considers credibility judgments following two types of (...) restatements – those resulting from fraud in which the character, ethics, and values of an organization may be called into question [cf. Copeland, Jr., J. E.: 2005, Accounting Horizons 19(1), 35–43.], and those resulting from non-fraud (i.e., aggressive accounting). Based on the information in the experimental case, non-professional investors take the role of potential equity investors and make a judgment about management’s financial reporting credibility after reviewing a set of post-restatement actions taken by a firm. The possible actions include changes in four corporate governance mechanisms (i.e., internal audit function, external audit firm, board of directors, CFO) and a buyback of company stock. Our results provide an important contribution to the literature by demonstrating that among non-professional investors, perceptions of management’s financial reporting credibility are affected both by the post-restatement action taken and the nature of the restatement. These results offer insight into the formation of a key credibility judgment made by non-professional investors following a trust-destroying event, an earnings restatement. (shrink)

Advocates of extended cognition argue that the boundaries of cognition span brain, body, and environment. Critics maintain that cognitive processes are confined to a boundary centered on the individual. All participants to this debate require a criterion for distinguishing what is internal to cognition from what is external. Yet none of the available proposals are completely successful. I offer a new account, the mutual manipulability account, according to which cognitive boundaries are determined by relationships of mutual manipulability between the properties (...) and activities of putative components and the overall behavior of the cognitive mechanism in which they figure. Among its main advantages, this criterion is capable of (a) distinguishing components of cognition from causal background conditions and lower-level correlates, and (b) showing how the core hypothesis of extended cognition can serve as a legitimate empirical hypothesis amenable to experimental test and confirmation. Conceiving the debate in these terms transforms the current clash over extended cognition into a substantive empirical debate resolvable on the basis of evidence from cognitive science and neuroscience. Phylogenetic information is often necessary to distinguish between evolutionary scenarios. Recently, some prominent proponents of evolutionary psychology have acknowledged this, and have claimed that such evidence has in fact been brought to bear on adaptive hypotheses involving complex human psychological traits. Were this possible, it would be a valuable source of evidence regarding hypothesized adaptive traits in humans. However, the structure of the Hominidae family makes this difficult or impossible. For many traits of interest, the closest extant relatives to the (...) human species are too phenotypically different from humans for such methods to provide meaningful data. While phylogenetic information can be useful for testing adaptive hypotheses in humans, these generally involve traits that are (a) not widely shared in the species or (b) fairly widely shared in the Hominidae family, and hence likely of a lower order of complexity than the sorts of traits evolutionary psychology has so far been interested in. The notion of a complete type can be generalized in a natural manner to allow assigning a value in an arbitrary Boolean algebra $\mathcal {B}$ to each formula. We show some basic results regarding the effect of the properties of $\mathcal {B}$ on the behavior of such types, and show they are particularity well behaved in the case of NIP theories. In particular, we generalize the third author’s result about counting types, as well as the notion of a smooth type (...) and extending a type to a smooth one. We then show that Keisler measures are tied to certain Boolean types and show that some of the results can thus be transferred to measures—in particular, giving an alternative proof of the fact that every measure in a dependent theory can be extended to a smooth one. We also study the stable case. We consider this paper as an invitation for more research into the topic of Boolean types. (shrink)

Based on a complete set of notes on Rabbi Soloveitchik's lectures, it constitutes a major contribution to our knowledge of both Maimonides and Soloveitchik.

I have become more convinced, over the years, by the truth of Wittgenstein’s characterisation of philosophy as arising through misconceptions of grammar. Such a misconception of grammar characterises a very popular approach to indexicality which has been current since the 1970s, stemming from the work of Casteñeda, and Kaplan. Gareth Evans was inclined to allow, for instance, that one could say ‘“To the left (I am hot)” is true, as uttered by x at t iff there is someone moderately (...) near to the left of x such that, if he were to utter the sentence “I am hot” at t, what he would thereby say is true’ (Evans 1985: 358). But not only does this disturb the proper relation between direct and indirect speech, it continues a Fregean tradition which these very cases show to be quite mistaken about the logic of intensions. In this paper, however, I want primarily to point out how this misconception of grammar has distorted our view of people. For some of the above thinkers have tried to make out that human motivation is related to the possession of a certain category of indexical belief, by Lewis called ‘de se beliefs’. I shall look here at how the matter arises in Hugh Mellor’s work on Time. In connection with Time, indexicality arises in McTaggart’s ‘A-series’, and Mellor treats this indexicality in parallel with Evans’ language. First, therefore, I aim to show how Mellor’s discussion of Time grammatically misconceives the situation, and leads to a misrepresentation of the motivation of human action. But a larger conclusion about Fregean intensions is also then immediately available. (shrink)

We introduce a dynamic model for evolutionary games played on a network where strategy changes are correlated according to degree of influence between players. Unlike the notion of stochastic stability, which assumes mutations are stochastically independent and identically distributed, our framework allows for the possibility that agents correlate their strategies with the strategies of those they trust, or those who have influence over them. We show that the dynamical properties of evolutionary games, where such influence neighborhoods appear, differ dramatically from (...) those where all mutations are stochastically independent, and establish some elementary convergence results relevant for the evolution of social institutions. This essay corrects an error in the presentation of the Paradox of the Knowledge-Plus Knower, which is the variant of Kaplan and Montague’s Knower Paradox presented in C. Cross 2001: ‘The Paradox of the Knower without Epistemic Closure,’ MIND, 110, pp. 319–33. The correction adds a universally quantified transitivity principle for derivability as an additional assumption leading to paradox. This correction does not affect the status of the Knowledge-Plus paradox as a rebuttal to an argument against epistemic closure, since (...) the quantified transitivity principle is true in the standard model of arithmetic and therefore innocuous. Perceptual learning mechanisms derived from Hebb's theory of cell assemblies can generate prototypic representations capable of extending the representational power of TEC (Theory of Event Coding) event codes. The extended capability includes categorization that accommodates “family resemblances” and problem solving that uses cognitive maps.

Health research has shown that overweight and obesity in children and adults are becoming significant public health problems in the developing world. Evidence suggests that this phenomenon is more marked in urban than rural areas and may be associated with modernization. However, the underlying reasons for this nutrition transition remain unclear. Dietary shifts, often in conjunction with income and time constraints in urban environments, may entail a greater reliance on more convenient sugar and fat-dense food. Also, the necessity of labor-intensive (...) agricultural work to meet rural subsistence needs is supplanted in urban environments by sedentary work. This paper extends the application of human behavioral ecology theory into the realm of international development and policy by applying Kaplan’s embodied capital theory to explore differences in food habits and nutritional status of Indo-Fijian children within the context of urbanization. Urban high-embodied-capital women demonstrate higher rates of wage-earning employment than urban low-embodied-capital or rural women. Findings indicate that urban high-embodied-capital households spend significantly more on food purchases, purchase a greater proportion of processed foods, and have children with higher body mass indexes (BMI) than do urban low-embodied-capital or rural households. This suggests that urban high-embodied-capital mothers, who tend to be employed, may be making trade-offs between income and food choices. (shrink)

Participants in this camp often emphasize the decisive (...) importance of language. They may argue that each language creates its own world within which every part of the symbolic system has its meaning in its relation to other parts of the system. Since language does not refer to a nonlinguistic reality, there is no possibility of translation among languages.Some who recognize the possibility of translation for some parts of the linguistic systems still reject any such possibility in the sphere of religion. It is in this sphere that the denial that language has nonlinguistic reference is most firmly insisted upon. It is urged that each religious system is simply what it is.The second group, the one to which I belong, holds that religious language does have referential character, and that dialogue, although complex and difficult, is possible and fruitful. But against those who hold that all religions are speaking, in their very diverse ways, of the same reality, we hold that the reality to which reference is made is multiple or diverse. It is our belief that the concrete and detailed study of religious experience and of the language through which it comes to expression enables us to distinguish these diverse references.To the best of my knowledge, Stephen Kaplan has written the first book-length argument in favor of this view. The contrast, of course, is with the common image of different paths up a single mountain to the same summit.Those of us who take this approach do not believe that every religious path leads to a different summit. Whether two paths lead to the same or different summits is to be decided on the basis of careful study of the traditions that follow these paths. Kaplan develops a threefold typology. One path is that of the theists, who seek communion with God. Another is that of Advaita Vedānta, which aims at final identity with the changeless real. A third is that of many forms of Buddhism, which seek to realize the wholly processive and interconnected character of all reality including the self.Kaplan rightly emphasizes his agreement with those who stress the importance of language and culture in shaping religious experience as well as its articulation. He does not take this to mean that we cannot discern families of experience, such as the experiences of those who seek communion with God. The experiences of those with this goal in diverse traditions differ in their imagery. The language used to speak of the experience is that of a particular community. But the judgment that what constitutes experience in multiple communities is theistic reality fits many of them. There are thus several paths to the same summit. But not all religious paths are directed to this theistic summit.Kaplan understands that a main objection to this radical religious pluralism is the deep-seated assumption that reality cannot have more than one fundamental character. If it is theistic, then the Hindu and Buddhist versions are in error. If either of them is correct, then all differing views are illusory. To adopt a radical pluralism is, then, in principle, to force a profound choice among religious traditions, holding that two out of three groups of traditions fail to provide paths up any mountain at all.Kaplan responds to this objection thoughtfully and thoroughly. He finds in David Bohm's holographic model a clue to how three very different views of reality may all be justified by one reality. This reply to Oleg Domanov’s target paper is not concerned with the technicalities of the proposed approach. Rather, I discuss the fruitfulness of the underlying ideas in dealing with Quine’s famous “double vision” scenario, for which the approach is designed. I point out some key ingredients of Domanov’s proposal: (a) context dependence of propositional attitude ascription (and ascribability); (b) replacement of individuals with finer-grained entities for reference and quantification, such as Kaplan’s “vivid names”, Frege and Yalcin’s senses or Percus (...) and Sauerland’s concept generators; and (c) using the apparatus of cross-identification functions. I show that those ingredients were already present in a body of work preceding the target paper. On the other hand, there are known problems related to the fact that sometimes the choice of the pertinent mode of presentation depends on the choices associated with quantifiers higher in the syntactic tree. No account based on manipulations with the global context, such as Domanov’s in its current form, can handle them. (shrink)

The paper develops some Wittgensteinean themes, such as the priority of demonstration, the nature of pictorial representations and the relation between interpretation and calculation, in the terms and concepts of Situation Theory. It attempts to weave some important elements of Wittgenstein’s thought in with an account of situated meaning and interpretation, without embarking on any archeological adventure. The paper is intended as a contribution to the philosophical foundations of Situation Theory and a critical commentary to some of its published accounts. Although Situation Theory has been developed with a sharp awareness of its antecedents in Bertrand Russell’s work, as well as its immediate heritage of central aspects of David Kaplan’s account of demonstrative reference, to my knowledge its Wittgensteinean roots have not been traced. The Groningen protocol allows for the euthanasia of severely ill newborns with a hopeless prognosis and unbearable suffering. We understand the impetus for such a protocol but have moral and ethical concerns with it. Advocates for euthanasia in adults have relied on the concept of human autonomy, which is lacking in the case of infants. In addition, biases can potentially influence the decision making of both parents and physicians. It is also very difficult to weigh the element of quality of (...) life on the will to live. We feel an important line has been crossed if the international medical community consents to the active euthanasia of severely ill infants and are concerned about the extension of the policy to other at risk groups. The validity of the double effect doctrine is examined in euthanasia and abortion. In these two situations killing is a method of treatment. It is argued that the doctrine cannot apply to the care of the dying. Firstly, doctors are obliged to harm patients in order to do good to them. Secondly, patients should make their own value judgments about being mutilated or killed. Thirdly, there is little intuitive moral difference between direct and indirect killing. Nor can the doctrine apply (...) to abortion. Doctors kill fetuses as a means of treating the mother. They also kill them as an inevitable side effect of other treatment. Drawing a moral distinction between the direct and the indirect killing gives counterintuitive results. It is suggested that pragmatic rules, not ethics, govern practices around euthanasia and cause it to be more restricted than abortion. (shrink)
